The Visa Bulletin is a bi-monthly newsletter from Visa that informs applicants of their current visa requirements and what to expect for the next month and beyond. For example, what visa requirements they must have in order to receive a Green Card or LPR status. And what final action dates they should be aware of. This month's Visa Bulletin has seven important bullet points. I've listed them here, in order of decreasing importance. The first one to the right is the top priority.

The first priority date for the final action date for the October 2021 revision is ” Changukeru Island, Borneo Island, Java Island, Lombok, Melaka, Tahiti, Sumatra, Borneo, and New Caledonia Island. These are the original destination areas that were affected by the earthquakes. A new destination area for the revised visa bulletin schedule is “Borneo, Sumatra, Borneo, Java, and Lombok.” These are all countries that experienced disasters in their respective regions of Asia.

The second bullet point on the second page of the Visa Bulletin for October 2021 has been updated to read “VIKING AND PHASE Miscellaneous Requirements.” This topic has been addressed on the second page of the recent informational sheet titled “VIKING AND PHASE Miscellaneous Requirements.” The three topics above were the main reasons why the revised immigration schedule was issued in the first place. The reason why the processing time for the visa application for the SIA visa has increased is due to the increase number of people applying for the visa, and the tightening of the requirements. The second page of the informational sheet addresses this issue in greater detail.

The third bullet point on the Visa Bulletin for October 2021 has been updated to read “STATutor Service forabus.” This is a service provided by the USCIS Southeast division. The fourth and final bullet point on the second page of the bulletin has been updated to read as follows: “NOTICE OF INELIGibility for immigrant parole (not otherwise eligible/ineligible)” is the second section of the second page of the informational sheet. There is a new line under” Notification of Ineligibility,” which now has been changed to read” Notification of Ineligibility for Immigration parole.” The second paragraph of the paragraph highlighting the final action dates in the United States for the six month period after the date of the applicant's last entry into the United States is also now highlighted in the informational sheet. There is a new line under “Filing Chart,” and there is a new reference in the third paragraph of the chart, where it is clarified that a final assessment of the applicant's eligibility is not made until the sixth month after the date of the applicant's last entry into the United States.

These four changes in the informational sheet are not enough, however. The four changes do not take into account the number of people who are newly arriving in the United States, nor do they take into account the number of people who are already in the system. If there are three hundred and fifty thousand immigrants from Mexico and three hundred and twenty-five thousand from Guatemala in the US, it would be expected that about fifteen percent of those immigrants would have a negative impact on the United States immigration system by the end of fiscal year 2021. But according to the USCIS, there will be no change to the numerical ceilings and numerical limits for the system. The USCIS has yet to make any determinations regarding the three hundred and ten thousand limits and the three hundred and twenty thousand limits.

The language on the visa bulletin indicates that the applicant's country of citizenship would not play any role in the determination of her eligibility. That would contradict the language in the United States Immigration and Nationality Act, which specify that a United States citizen is presumed eligible for an immigrant visa regardless of the nationality of that citizen. It is also confusing when an act of Congress, which is enacted by an American citizen, is interpreted by the agency within the Department of Homeland Security as meaning something else. The visa bulletin clearly indicates that an applicant must first establish that she or he is an alien eligible to apply for an immigrant visa. In other words, the applicant would have to convince the USCIS that he or she is eligible for a visa, which would include providing documentary evidence of the applicant's identity and of the reasonableness of the applicant's claim to citizenship.

The USCIS advisory concerning the expiration date of the ILR, as provided in the Visa Bulletin, also provides incorrect information on the types of reasons that would result in the cancellation of a visa. According to the visa bulletin, the applicant's failure to comply with any condition to renew the ILR or the application for another immigrant visa would result in the cancellation of the immigrant visa. However, according to the law, any misrepresentation of facts on the application for immigration status would also result in the cancellation of the visa. This includes misrepresentations about employment, nationality, investment opportunities, or any other immigration-related grounds. In this regard, if the applicant is found to misrepresent the truth on any aspect of the application for immigration, even if that fact is within the discretion of the applicant as defined by the law, then the visa will be immediately canceled.
